Who this policy applies to
This policy applies to Nowland Group Pty Ltd t/as Morella Finance (ABN 50 665 338 947), Authorised Credit Representative #581474 of Jade Equipment Finance Pty Ltd (ABN 15 161 985 280), Australian Credit Licence #484387. In this policy, "Morella Finance", "we" and "us" means Nowland Group Pty Ltd t/as Morella Finance.
It explains how we collect, hold, use and disclose personal information and credit information under the Privacy Act 1988 (Cth), the Australian Privacy Principles and the Privacy (Credit Reporting) Code. It covers this website, enquiries you send us, and the credit assistance we provide.
Before we obtain a credit report about you or submit a credit application on your behalf, we will ask you to read and sign our Privacy Consent, which sets out these terms in full together with the list of credit providers we may submit applications to.
What is personal information
Personal information is information or an opinion about an identifiable or reasonably identifiable person. The personal information we collect and hold includes your name, date of birth, gender, phone number, address, email, employment details and any other information we need to identify you.
What is credit information
Credit information is personal information that relates to credit that a person has applied for or has been provided. It may include records of credit you have applied for (including the name of the credit provider, the type of credit and the amount of credit), default information and any other information that has a bearing on your credit worthiness and is used to determine your eligibility for credit. It also includes credit reporting information supplied to us by a credit reporting body, and any information we derive from it.
Why we collect it
We are required by the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) to collect and use personal and credit information in order to identify you. We are also required by the National Consumer Credit Protection Act 2009 (Cth) to collect credit information and personal information about you and take reasonable steps to verify it, including your financial situation. This verification may include an enquiry with a credit reporting body.
We may not be able to provide credit assistance without the ability to collect, hold, disclose and use your personal and credit information.
You can browse this website without telling us who you are. You only need to give us personal information if you want us to act on an enquiry.
How we use your information
We collect, hold, disclose and use your personal and credit information to do the following.
- Assess and verify your identity and financial situation
- Assess your credit application, or your suitability as a guarantor to a credit application
- Provide information to a guarantor or related applicant
- Exchange your information with a credit reporting body
- Disclose your information to credit providers to arrange credit
- Disclose your information to our aggregation partner
- Disclose your information to an insurer to arrange insurance you wish to obtain
- Obtain information from, and disclose it to, third parties such as your employer, landlord, real estate agent, lending institution and guarantor, where reasonably necessary to arrange finance or insurance
- Refer you to other organisations, service providers or business partners, or receive referrals from them
- Contact you about your enquiry or application
- Understand how this website is used and measure our advertising, as described below
Who we disclose your information to
We may disclose or exchange your personal and credit information with the following.
- Potential credit providers and insurers, as part of our credit assistance process
- Third parties who help us verify the details you give us, including your agents, guardians, attorneys and employers
- Our related bodies corporate, assignees, agents, contractors and advisers
- Law enforcement, government and regulatory bodies
- Anyone who refers you to us for credit assistance
- Joint applicants and guarantors
- Any financial institution to or from which a payment is made
- Debt collection agencies
We do not sell your personal information.
Our aggregation partner
We have a finance aggregation arrangement with Fintelligence Pty Ltd (ABN 80 625 017 174), Australian Credit Licence #511803, which helps give us access to a wide range of credit providers. We may use their systems as part of our credit assistance process and for ongoing client contact. We may also share your details as part of compliance audits.
Credit reporting
We may exchange personal and credit information with a credit reporting body. As an access seeker in the credit assistance process, we may do the following.
- Disclose details such as your name, date of birth and address to obtain a credit report about you as an applicant or guarantor
- Use information provided by a credit reporting body to help with our preliminary assessment of a proposed credit application and whether it is suitable for you
- Ask a credit reporting body to confirm whether the information you have given us matches the information in your credit report, to verify your identity
Our current credit reporting body is Equifax. You can contact Equifax on 13 8332, Monday to Friday, 8.30am to 6pm Eastern Standard Time, or at www.equifax.com.au, where you can also read its privacy policy.
Credit providers
We may submit a credit application to the credit providers listed in the Credit Provider Schedule in our Privacy Consent. If a credit provider holds relevant credit eligibility information, it must share this with us, with you, or with someone you have authorised to act on your behalf. Credit providers may also make a credit enquiry directly with a credit reporting body, and each explains how it handles personal and credit information on its own website. If your application proceeds with a credit provider, that credit provider may ask for your consent again.
Credit providers may give your personal information, including details of your driver licence or passport, to an organisation that verifies identity, including a credit reporting body, to check whether it matches the information held by the issuer of the document. This may include electronic identity verification. Other ways of verifying your identity may be available.
Information collected on this website
When you visit this website, some information is collected without you entering it. We use it to keep the site working, to protect it from spam and misuse, to understand how it is used, and to measure whether our advertising leads to enquiries.
- Technical information about your visit, such as your approximate location, device type, browser, operating system and screen size
- Page performance measurements, such as how quickly pages loaded and responded
- How you moved through the site, such as the pages you viewed, the calculators you used and the buttons you selected
- The site, search or ad that sent you here, and the page you landed on
- Server logs kept by our hosting provider, which include IP addresses, for security and troubleshooting
We use the following services to do this.
- Vercel, which hosts this website and measures page performance
- Google Tag Manager and Google Analytics, which measure how the site is used
- Google Ads and Microsoft Advertising, which measure whether our ads lead to enquiries and may show our ads to people who have visited this website
- Cloudflare Turnstile and Upstash, which protect our enquiry forms from spam and automated abuse and may process your IP address to do so
- Resend and Microsoft, which deliver and store the emails created when you send an enquiry
Google Analytics data is kept for 14 months.
Ad click identifiers
If you arrive from one of our ads, we record the ad click identifier from Google or Microsoft, along with the campaign details in the link, the site that referred you and the page you landed on. We keep this in a cookie on your device for up to 90 days. If you send an enquiry, this information is attached to it so we can tell which ads lead to enquiries.
If an enquiry later leads to a loan, we may tell Google or Microsoft that the ad click led to a result, using the click identifier. We do not send your name, email address, phone number or financial details to our analytics or advertising services.
Cookies and your choices
A cookie is a small file stored by your browser. We and our service providers use cookies and similar technologies, such as local storage and tracking pixels, to make the website work, to remember where a visit came from, and to measure usage and advertising.
You can choose how we use cookies at any time through the Cookie preferences link at the bottom of every page. It lets you accept all cookies, keep only the ones the site needs to work, or choose for yourself. Until you make a choice, analytics and advertising cookies are active, and choosing "Only what is needed" turns them off.
Most browsers also let you refuse or delete cookies. Blocking cookies does not stop you using this website, although some parts of it may not work as smoothly.
Overseas disclosure
Some of the organisations we may disclose personal information to are located overseas, or store and process information overseas, including in the USA, Canada, Malaysia, India, Ireland, the United Kingdom, Serbia and the Philippines.
Our website, analytics, advertising and email service providers (Vercel, Google, Microsoft, Cloudflare, Upstash and Resend) are based in the United States and may process data there and in other countries where they operate.
Before we disclose personal information to an overseas recipient, we take reasonable steps to make sure it is handled consistently with the Australian Privacy Principles.
How long we keep your information
We keep personal information only as long as we need it or as long as the law requires, whichever is longer.
- Records of credit assistance we have provided are kept for 7 years from the date the assistance was provided, as the National Consumer Credit Protection Act 2009 (Cth) requires
- Enquiries that do not proceed to an application are kept for 2 years
- Marketing contact details are kept until you opt out, and for a short time afterwards so we can honour the opt-out
- Google Analytics data is kept for 14 months, and other website service data for the period set by each provider
When we no longer need personal information and no law requires us to keep it, we destroy or de-identify it.
Marketing
We would like to contact you from time to time with information about the products and services we provide. You can opt out of direct marketing from us at any time by using the unsubscribe link in any marketing email, phoning 07 2145 8323, emailing enquiries@morellafinance.com.au or writing to PO Box 1210, Mudgeeraba QLD 4213.
We will still contact you about an enquiry or application you have asked us to handle, because those messages are not marketing.
Electronic communication
If you give us an email address or mobile phone number, you consent to us using it to send you, or make available to you, notices and relevant documents, including those from a credit provider or insurer. Paper copies may not be provided unless the law requires it, so please check your email and messages regularly and tell us promptly if your details change. You can withdraw this consent by phoning 07 2145 8323, emailing enquiries@morellafinance.com.au or writing to PO Box 1210, Mudgeeraba QLD 4213.
How we protect your information
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Information you submit through this website is sent over an encrypted connection, and access to client records is limited to people who need it to do their work. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
Your rights
You have the right to ask us for the personal and credit information we hold about you, to ask us to correct anything that is inaccurate, and to ask for a copy of this policy and our Privacy Consent. You can also ask a credit reporting body not to use your information for assessment purposes or direct marketing, and ask it for a copy of the information it holds about you.
To access or correct your information, contact us using the details below. We will respond within 30 days. We may need to verify your identity first.
Complaints
If you believe we have breached your privacy, please contact us first using the details below and give us as much detail as you can. We will respond within 30 days.
If you are not satisfied with our response, you can contact the Australian Financial Complaints Authority (AFCA) at www.afca.org.au or on 1800 931 678, or the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.
